Brexit: Dispute Resolutions and Contracts

The impact of Brexit on dispute resolution and contracts is likely to be mixed. The UK will need to reach new arrangements to ensure the mutual recognition of judgments with EU states, and the changed legal and economic circumstances will give rise to some commercial disputes.

At the same time, English law remains one of the best-established and most sophisticated bodies of commercial law for parties to use, and London remains an attractive centre for international dispute resolution. International arbitration, and England’s leading role within it, will be unaffected by Brexit.

Despite this, companies will need to continue to review their contractual arrangements to ensure that they are best insulated against risks and able to see the new opportunities afforded by Brexit.
