The Graduate European Programme 2012/2013 Terms and Conditions for Companies

Definitions
Spanish Chamber of Commerce in Great Britain (“the SCC”)
The Graduate European Programme (“the Programme”)
The graduate participant on the programme (“the Participant”)
The Company participating in the Programme (“the Placement Company”),
European Business School (EBS)
Internexus (INT)
This documents sets out the terms and conditions under which the Placement Company agrees to accept Participants under the Programme run by the SCC.


Placements
The SCC will allocate to the Placement Company one Participant per available placement based on the job description(s) which have been provided to the SCC by the Placement Company.  An interview will take place in order for the Placement Company to be satisfied with the profile match.  Placements will be for 6 months from the first day that the Participant starts work.  Any extension to the placement or any offer of employment made to the Participant after the end of the 6 month period is strictly by agreement between the Placement Company and the Participant.


Expenses
Payment towards the Participant’s travel and lunch expenses will be paid by the Placement Company at a minimum rate of £95 per week.  This figure is in accordance with the HMRC guidance, as the minimum non-taxable allowance.  The precise figure and method of payment of expenses is at the discretion of the Placement Company and should be communicated to the Participant.  For Placement Companies located outside Zone 3 this figure should to be increased in line with travel costs for the applicable distances. The Placement Company agrees to pay the expenses direct to the Participant on a weekly or monthly basis.


English Classes and Business Workshops
As part of the Programme, Participants are required to attend compulsory external classes and workshops.  The Placement Company agrees that the participant will be released to attend classes as follows:-
English classes at INT will take place every Tuesday and Thursday from 5:15 – 7:15pm;
Business Workshops at EBS will take place every fortnight on a Wednesday from 5:15 – 7:15pm.
These days and times may be subject to change at short notice if tutors are not available and Placement Companies are requested to be flexible concerning the days and times when Participants are to be released.  Participants will be required to leave work early in some cases in order to arrive at Regent’s College on time.
References
The Placement Company agrees to provide a reference to the Participants on completion of the Programme, providing details of the type of work experience undertaken by the Participant and giving a brief assessment of the Participant’s performance in the role.


Cancellation Policy
If this agreement is cancelled, the following provisions apply:-
A withdrawal of the offer of a placement to a Participant must be notified in writing to the SCC office.  The day that notification is received in writing by SCC is the official cancellation day and the cancellation provisions set out below will apply:-
If the withdrawal of any placement is made during the 2 week period prior to the start date of the Programme and no alternative Placement Company can be found, the placement will go ahead as planned for a maximum of 2 weeks until an alternative placement is found for the Participant;
If a placement is terminated after the programme has started without the Participant being at fault, the placement will go ahead as planned for a maximum of 4 weeks until an alternative placement is found;
Weekly financial contributions shall continue to be provided by the company during the time that it takes to find an alternative Placement Company up until the agreed length of time has elapsed in both the above cases.


Complaints
If the Placement Company believe it has a genuine reason for complaint, SCC should be notified as soon as possible.  SCC will then respond to the Placement Company and will endeavour to do everything possible to resolve any problems.  SCC will not be able to respond to complaints received after the Participant has finished the Programme, unless SCC had been notified of the complaint whilst the Participant was taking part in the Programme and SCC had been given a reasonable opportunity to resolve any problems.


Accuracy of information provided

Agreement
The Placement Company agrees to the following terms:
that the information supplied on the application form and job description is correct;
to pay expenses to the Participant as set out above and to pay the minimum weekly amount direct to the participant;
that Placement Companies located outside Zone 3 will need to make a higher financial contribution of expenses to the Participant;
to comply with the cancellation policy outlined above;
that the Participant is permitted to leave early when there is an English class or Business Workshop;
that a suitably qualified Participant for the Company may not have applied for the programme and therefore the placement may not be filled;
that the SCC accepts no liability whatsoever for any losses incurred by the Placement Company as a result of any acts or omissions by the Participant during the Programme, howsoever caused.
